Transfer of Equity

Changing whose names are on the title of a property — whether adding someone or transferring it into a sole name — is called a transfer of equity, and we can handle it for you.

When you might need a transfer of equity

If you are currently a joint owner of a property and wish to have the property transferred into your sole name — whether it is subject to a mortgage or not — we can do that for you. Similarly, if you currently own a property solely and wish to transfer it into the joint names of yourself and another, we can do that too.

If the property is mortgaged: the consent of your mortgage lender will be required before the matter can progress. You will need to apply to your mortgage lender for that consent.

Step by step

What we do on a transfer of equity

A typical transaction involving a transfer from joint names to a sole name, subject to an existing mortgage.

  1. Obtain the title

    If the title is currently unregistered we obtain the title deeds to the property; if the title is registered at the Land Registry we obtain Official Copy entries.

  2. Check for other charges

    We check the Official Copy entries to ensure that no other charges have been registered after the mortgage.

  3. Prepare the Transfer deed

    Once the mortgage lender issues written consent to the transfer, we prepare a Transfer deed in accordance with the lender's instructions and arrange for it to be signed by both property owners and the lender.

  4. Final searches

    We carry out all final searches in respect of the property.

  5. Pay any agreed sum

    If the transfer is proceeding at a price, we pay the agreed sum to the party transferring their interest in the property.

  6. Register the transfer

    We register the transfer at the Land Registry and, once registered, return the deeds to the mortgage lender or forward them to you for safekeeping.

Most transfer of equity transactions can be completed within about 4 weeks of instruction, depending on how quickly the mortgage lender issues consent to transfer.
